(UK Model Envy is not shy so feel free to take a look at our T's And C's) Terms & Conditions  2010 It is agreed that the following terms set out the total contract made between the parties involved and that no variation or modification of this contract shall be effective unless agreed by all parties in writing. Payments No photographs / web work will be collected or delivered until all payments due have been paid in full. Payments for images/ services are to be agreed to be paid in full upon placing the order . All images / Services provided by us remain the sole property of UK Model Envy until paid in full. Stage payments will be collected as listed and agreed by the customer and signed for on their invoice, any stage or cancelled invoices will have their payments re-submitted at our discretion until the full lnvoiced amount has been paid. Any missed staged payments or financial payment to UK Model Envy or third parties will result in the removal of your online website. Display UK Model Envy may display any photographs included in this contract in his/her studio, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows. Your images may also be used online and your data submitted to third parties for marketing purposes. All models are hosted online for a period of 12 months from the date of their invoice and may be removed at any time at our discretion. Images All image sizes are normal or bespoke. UK Model Envy will provide a pleasing colour balance, but cannot guarantee exact colour matching. It is sometimes impossible to capture the exact colour as seen by the human eye. Retouching Retouching, digital manipulation and artist finishing is available to the Client as an optional extra. Reorders All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing. Copyright Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the express permission of UK Model Envy in writing. UK Model Envy reserves the right to sell images taken by us for financial gain without giving notice. All images remain copyright of UK Model Envy Licence UK Model Envy shall be granted licence in relation to the poses photographed and the location used. The Photographers judgement regarding the location/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. Force majeure or Act of God The due performance of this contract is subject to alteration or cancellation by UK Model Envy owing to any cause beyond their control Attendance In the unlikely event of the assigned Photographer being unable to attend your portrait sitting due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your portrait sitting on our behalf to undertake the portrait sitting to his/her best ability. Limitation of Liability In the unlikely event of a total photographic failure or cancellation of this contract or in any other circumstances UK Model Envy  reserves the right to re-book a new appointment time to rectify the loss. UK Model Envy shall not be liable for indirect or consequential loss. Negative/Digital Files Negatives/digital files remain the property of UK Model Envy Prices All invoices and Finance agreements are non cancellable, Models that fail to attend their photo shoot will have their portfolio/Website services completed using existing images taken from their first shoot. All prices are subject to the current rate of V.A.T (if applicable). Complaints Any complaints should first be raised by the Client with UK Model Envy in writing within 7 days from the date of receipt of images. Recovery/Collection In the event of any account remaining unpaid for more than 10 days from the date on which settlement becomes due,UK Model Envy  will instruct Daniels Silverman.Ltd to instigate debt recovery procedures for UK Model Envy. UK Model Envy is entitled to charge £50.00 + V.A.T to locate the whereabouts of a debtor adding to the outstanding invoice amount, UK Model Envy will charge the sum of £25 for each cheque which is dishonoured. UK Model Envy reserves the right to amend these terms and conditions without notification. Theme Days UK Model Envy reserves the right to refuse theme day bookings to models at our discretion, This service may be withdrawn at anytime without prior notice. The theme shoot service lasts for 12 months per invoice per model starting from the date the invoice is created. Models that require images from the photoshoot theme days uploading onto their site will be subject to a small fee to cover editing, airbrushing & uploading onto their site.
